“I don’t see this as a court that is just like, ‘We’re just going to rubber stamp what the current administration does.’ You know, quite the opposite,” Kagan remarked during her address in Bellevue, Washington. “I think that that is a bad rap.”

The liberal justice highlighted several landmark decisions that underscore the court’s willingness to stand against presidential overreach. Among these were rulings that struck down Trump’s expansive tariff policies and rejected his attempts to terminate birthright citizenship for children born in the United States to undocumented immigrants.

“Is this court very conservative? Does it do a bunch of things that are out of the playbook of the conservative legal movement that I think are deeply wrong? You know, yes,” Kagan said. “But is this court the kind of puppet for the current administration? I think definitely not.”

Kagan characterized the court’s invalidation of Trump’s tariffs as one of the most significant rebukes ever delivered to a sitting president. She noted that tariffs represent a cornerstone policy issue for Trump—something he campaigned on, championed, and cared about deeply. According to Kagan, it is rare for courts to strike down such an important policy affecting a current president.

While acknowledging her disagreements with numerous recent decisions, including those she described as having “eviscerated” the Voting Rights Act, Kagan stressed that her dissent stems from judicial philosophy rather than political alignment. “You just have to deal with the fact that there’s a conservative court doing things that conservative jurists have long thought it appropriate to do, and I can really dislike that,” she explained. “But it has nothing to do, I think, with becoming the arm of this current administration.”

The justice also reflected on a historic moment earlier this year when Trump became the first sitting president to attend Supreme Court oral arguments regarding his birthright citizenship order. Kagan described the experience as unremarkable from a procedural standpoint. “He was just like a person who came in and sat down and then had to listen to an argument,” she said, noting that many attendees in the courtroom could barely see him.

Through her comments, Kagan reinforced the message that while the court operates with a conservative majority and has issued decisions that may surprise some observers, it continues to function as an independent branch of government rather than a passive follower of presidential directives.
